Consumer and shopping claims question:

A week a go my partner paid a £50 holding deposit on a car so that she could arrange finance on the purchase. At the time of payment the salesman told her the payment was refundable if she decided not to go ahead, in writing on the receipt it says the deposit is non-refundable. Having seen the car in daylight it appears the car is in a state not making it worth the price being asked so my partner has withdrawn from the purchase, The salesman is now telling her that he will not refund the deposit. Is he entitled to do this or has she lost the money?
