Buying a flat or house question:

My previous conveyancing solicitor (which has been taken over by another practice) fail in his searches to advise me that my home Bio tech treatment tank discharged into a culvert on the neighbouring farmers land. The farmer has now partially filled in the culvert, which has restricted the discharge flow from soaking away. I have since aquired a full copy of the enviroment agency discharge certificate drawings which shows the discharge point as being on the farm land, I was only give the Discharge certificateit's self. The tank was installed just over six years ago before I bought the house, but apparently no permissions were sought from the farmer. How do I stand legally as this is now going to cost me a lot of money to get the problem put right. The farmer doesn't appear to be concerned. I am in the process of trying to sell my house but is held up until this situation is resolved.
