Immigration question:

I am 50 years old and got LLR for five years including my dependants such as my wife (45), Daughter (14) and son (7). We will apply for ILR soon but I am a bit worried because some small personal family issues, me and my wife got into a little argument and my wife got a bit mad and called police for me. As the police arrived she did not know what to say to them as she was very nervous and does not speak much English. How ever police suspected something serious had happened and took me into custody for 4/5 hours until they manage an interpreter to interview my wife to discover what had actually happened. By the time my wife was clam down and told them the actual fact and then police let me come home safely and told me that I wasn't convicted of anything but meanwhile they taken my details including DNA and finger print into their record. Even they didn't give me any letter or any document about it for my own record or counter. For your information please note that, we married 27 years ago and still she is my dependants and I will apply for her ILR. Actually I would like to know that, Is it any problem or affect for our ILR application in near future? Also want to know how could I find out a document from police station regarding this matter if required in future. Don't hesitate ask me any further clarification will be required. Thanking you.

It would be in your best interests to clarify how the incident was recorded by the police and you should make enquiries with the police station who dealt with the incident. If you find you are having difficulties in obtaining clarification in writing then you can request the information under the Data Protection Act and pay a fee of £10. You should contact the police station to obtain details of how to go about doing this.

If there is no indication that your relationship has permanently broken down and yourself and your wife continue to live together as husband and wife; then you are fully in your rights to make an application including her as your dependant. It may however be a good idea to instruct a solicitor in the settlement application to ensure that statements and good representations are included with the application in order to properly protect your positions.
