Accident claims question:

I had a car accident nearly 3 years ago, I've been told by my consultant that I will suffer pain in my neck, shoulder & arm for the rest of my life, I will need pain killing injections these only last 4 months at a time, if i get these done on the NHS i will have to waith at least 4 months everytime after the previous injection has worn off, I need to get this done privately but as this costs £3000 a time I can't afford it and my solicitor says i will only get about £6000 for the accident which will only pay for 2 injections, I can't live with sort of pain for the rest of my life is there anything i can do to get the third party to pay for my on going care. Please help. thank you

The medical evidence will be the deciding factor. If the medical expert who has prepared a report in your claim considers that your ongoing problems are caused by your accident then you will be able to make a claim for the private cost of any future treatment. Also if the consultant believes that you need care as a result of the injuries sustained in your accident then you can claim the costs of care and assistance.

Speak to your solicitor about it and he/she will no doubt explain it to you in more detail.

If liability for the accident is likely to be established it should be possible to seek early interim payments to cover the cost of rehabilitation, and pain management. If this treatment is reasonable and necessary, you will be able to claim the full cost of the private treatment as part of your claim.

Be aware though that there is a 3 year limitation period for personal injury claims - court proceedings have to be issued within 3 years of your injury or 'date of knowledge' otherwise your claim may be out of time. If you are approaching the 3 year limitation date you will need to act quickly.
